LenBee.com is made available to you under these Terms. You agree to be bound by the Terms as modified from time to time. Your continued access or use of LendBee.com after such changes are posted on this site will be deemed to be your agreement to the amended Terms.

Eligibility
LendBee.com is not intended to be used by persons below 18 years of age. You represent and warrant that you are 18 years of age or older by creating an account or accessing LendBee.com.

User Account
You agree to provide accurate and truthful information as part of the registration process (“User Information”). You also agree to promptly update your User Information to keep it true, accurate, current, and complete. LendBee.com reserves the right to terminate your account at any time if the User Information provided by you is found to be untrue, inaccurate, outdated, or incomplete.

Lending and Borrowing
LendBee.com allows you to post details of books, CDs, DVDs and other Items ("Item" or "Items") that you wish others to borrow from you. You represent that you are the owner of the Item posted or that you have express provable consent of the owner to lend such Item. However, there is no obligation upon you to lend the Item that you have posted on LendBee.com. LendBee.com is intended solely as a platform for exchanging information. LendBee.com does not, in any manner, facilitate or assume responsibility for the physical transaction of lending or return of the borrowed Item. LendBee.com does not act as the agent of the lender or borrower.

User Responsibilities:
You agree to the obligations given below as part of using LendBee.com:

• You are solely responsible for determining whether your use of LendBee.com violates any laws. By accessing and using LendBee.com, you represent and warrant that your use of LendBee.com does not violate any laws or regulations.
• LendBee.com does not own Items posted on LendBee.com for lending. Neither has LendBee.com verified the genuineness or quality of such Items. You are solely responsible for verifying the genuineness and quality of the Items before borrowing them.
• In order to borrow the Items posted for lending on LendBee.com, you may have to communicate with or meet the Owner. LendBee.com does not certify the character or motives of its Users. You are expected to exercise independent judgment during such interactions. You agree to promptly inform LendBee.com of any improper behavior of LendBee.com users.
• LendBee.com does not endorse, guarantee, warrantee, or make any representations regarding views, advice or suggestions you may receive from this site. Please consult qualified and licensed professionals before acting upon any such advice.
• It is likely that the Items you had lent may be damaged or the borrower may not return the Items borrowed. You are solely responsible for the decision to lend your Items. LendBee.com does not assume any responsibility in this regard.

Restrictions on Use
As part of using or accessing LendBee.com, you agree that you shall not:

• post for lending any Item if you are not the owner or permitted by the owner to lend the Item.
• post for lending or borrow any Item in violation of any law or regulation.
• post for lending any software other than those that are permitted to be lent according to its license terms.
• communicate with another User of LendBee.com in a manner that is improper, intimidating or harassing.
• post on LendBee.com, content or Item containing content that is unlawful, harassing, libelous, invasive of another's privacy, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable, or that infringes or may infringe the intellectual property or other rights of another.
• attempt to access, through hacking or by any other means, the personal information of LendBee.com Users.
• use LendBee.com for spamming or any other illegal activity.

Privacy and Security
While creating an account at LendBee.com, you will be requested to provide personal information including your name and email address. You may choose not to provide personal information that is not marked as mandatory. If you do not provide personal information that is marked as mandatory, you will not be able to create an account at LendBee.com. You personal information may become available to other Users during requests for borrowing. LendBee.com will not otherwise share or disclose your personal information without obtaining your prior consent. You will be provided access to your personal information. You may correct, update or remove any such personally identifiable information by logging into your account. LendBee.com has implemented appropriate data collection, storage and processing practices and security measures, as well as physical security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information.

Copyright Complaints
If you believe that content or any Item posted on LendBee.com has violated your copyright or other intellectual property right, please write to us providing the following information:

1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property right alleged to be infringed
2. a description of the copyrighted work or other intellectual property that you claim to have been infringed;
3. identification of the material that you claim to be infringing including information regarding its location that would enable it to be located and if possible the URL of such infringing material;
4. information that would enable us to contact you, such as your address, telephone number, and email address (if available);
5. a statement by you to the effect that you believe in good faith that the use of the infringing material in the manner complained of is not authorized by the copyright or intellectual property owner, its agent, or the law;
6. a statement by you, under penalty of perjury, that the above information contained in your communication is accurate and that you are authorized to act on behalf of the owner of copyright or other intellectual property right;

Termination of User Account
You agree that LendBee.com may terminate your account at any time for reasons including, but not limited to, breach or violation of these Terms, a request by you to terminate your account, extended periods of inactivity, discontinuation of LendBee.com, unexpected technical issues and requests by law enforcement or other government agencies. LendBee.com reserves the right to terminate your account upon receiving a complaint of violation of the Terms from another User against you. Termination of your account includes termination of access to LendBee.com and deletion of information pertaining to your account.

Indemnification
You agree to indemnify and hold harmless LendBee.com, employees, and affiliates, from and against any losses, damages, fines and expenses (including attorney's fees and costs) arising out of or relating to any claims that you have used LendBee.com in violation of another party's rights, in violation of any law, in violations of any provisions of the Terms, or any other claim related to your use of LendBee.com.

Disclaimer of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT ACCESS OR USE OF LENDBEE.COM IS AT YOUR SOLE RISK. LENDBEE.COM IS PROVIDED ON AN AS-IS-AND-AS-AVAILABLE BASIS. LENDBEE.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. LENDBEE.COM MAKES NO WARRANTY THAT ACCESS OR USE OF LENDBEE.COM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR VIRUS FREE. USE OF ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH ACCESS OR USE OF LENDBEE.COM SHALL BE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, MOBILE TELEPHONE, WIRELESS DEVICE OR DATA THAT RESULTS FROM ACCESS OR USE OF LENDBEE.COM OR THE DOWNLOAD OF ANY SUCH MATERIAL. NO ADVICE OR INFORMATION, WHETHER WRITTEN OR ORAL, OBTAINED BY YOU FROM LENDBEE.COM, ITS EMPLOYEES OR REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LENDBEE.COM BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER LOSS OR DAMAGE WHATSOEVER OR FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, COMPUTER FAILURE, LOSS OF BUSINESS INFORMATION, OR OTHER LOSS ARISING OUT OF OR CAUSED BY YOUR USE OF OR INABILITY TO ACCESS OR USE LENDBEE.COM, EVEN IF LENDBEE.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH LENDBEE.COM RELATED TO ACCESS OR USE OF LENDBEE.COM SHALL BE TERMINATION OF YOUR ACCOUNT.

Governing Law and Jurisdiction
This Agreement will be governed by and construed in accordance with the Indian Law exclusive of its conflict of law provisions. All disputes arising out of or resulting from use or access of LendBee.com shall be subject to the exclusive jurisdiction of courts at Chennai, India.
